T.O.S

By commissioning The Artist, you agree to and acknowledge the terms of service.The Artist reserves the right to refuse a commission request without written or verbal reason.The Artist reserves the right to post
commissioned artwork to their art accounts/websites/social media/portfolios, as well as streaming the creation process on Twitch.

Fees

Additional fees may occur at the artist's discretion. Examples of situations that may add additional fees include, but are not limited to:

Payments

All payments must be made through PayPal. Foreign exchange rates may apply. Full payment for the commission is required before sketching.In the event of a commission valued at or over $100, a 75% downpayment is required instead before sketching.The Artist will accept payments in installations for any commissions over $100. This will be discussed in applicable situations.Upon acceptance of a commission request, The Artist will send you an invoice for the amount agreed upon.

Refunds

A 100% refund will be given if The Artist or The Client cancels the commission before any work has been done. Outside of this circumstance, no refunds will be allowed.

Process

1. To begin a commission request, please provide The Artist a detailed description of the work desired. In addition to this, please also provide at least one reference. After you submit a commission request, the artist will then review it.2. The Artist will then provide a quote for the price of the art along with an estimate on how long it will take to be delivered. Times may vary based on queue length.3. Once the payment has been accepted, the artist will add the commission to the work queue. When in the active queue, the commission will take anywhere between 3-9 weeks. Times may vary based on complexity, but The Artist will keep The Client informed.4. When the commission has reached the front of the queue, the artist will begin working on it.5. The Artist will provide a rough sketch of the commission for the client to review and approve, or to request any changes.6. After the Client is satisfied with any revisions, the artist will begin line work.7. Upon completion of the line work, the artist will provide a work-in-progress update to The Client. Minor revisions may be made here, but a complete overhaul of the piece may accrue additional fees.8. After the line work has been completed, the artist will begin the flat colors process.9. Upon completion of the flat coloring process, The Artist will provide a work-in-progress update to The Client. This is the stage where any color change requests can be made.10. The Artist will then begin the shading and finalization portion of the piece. No additional revisions are allowed at this point of the process.11. The Artist will deliver the completed commission to The Client via E-mail or Discord, with the completed artwork in PNG format.

Rights and Permissions

The Artist retains all artistic rights to commissioned work.The Artist may use artwork in online or physical galleries, portfolios, printed material, any form of publication or distribution.The Artist's work is not to be used for NFTs or in AI Generators.The Client must make a reasonable attempt to provide proper credit to the artist if posting/utilizing the art. This can be done by providing a link to this Carrd, or crediting The Artist's username on that specific platform.The Client must not edit, copy, trace, distribute or modify without The Artist's written permission. This excludes cropping for icons, signatures, layouts, wallpapers, social sites, etc.The Client is not permitted to use commissioned artwork for commercial use or in any form of promotion for profit unless the commercial rights fee has been paid.
